What happens to the trade-in when a California used-car buyer cancels within 3 days?
Quick answer
The dealer must give the trade-in and all keys back. If it has already sold the trade-in or started transferring its title, it must pay the greatest of three amounts: the trade-in value in the contract, what the dealer sold it for, or its fair market value, minus any loan still owed on it. The dealer must also give an itemized receipt (Civil Code 1784.43(a)(3)).
What does the law say? Key facts and official sources
| Item | What the law says | Source |
|---|---|---|
| Return | Trade-in vehicle and all keys returned unless the dealer sold it or started the title transfer (1784.43(a)(3)(A)) | Official source |
| If already sold | Refund is the greatest of: agreed value in the contract, the dealer's sale price, or fair market value (1784.43(a)(3)(A)) | Official source |
| Loan payoff | The dealer may deduct the amount needed to pay off a loan secured by the trade-in (1784.43(a)(3)(B)) | Official source |
| Receipt | Itemized receipt for each deduction, with the date and time the buyer cancelled (1784.43(a)(3)(B)) | Official source |
| Fair market value | Presumed from a written offer to the buyer valid at least 7 days and honored by the dealer, or a nationally recognized pricing guide at the time of cancellation (1784.43(a)(3)(C)) | Official source |

Can a dealer resell a trade-in during the 3 days?
The statute does not forbid it, but it sets the price of doing so. If the dealer sold the trade-in or started the title transfer before the buyer cancels, it owes the highest of the agreed value, the resale price, or fair market value.
How is fair market value proven?
The dealer gets a rebuttable presumption if it uses one of two methods: a written offer to buy the trade-in that the buyer received, that the dealer honors, and that is valid for at least seven days; or the trade-in value in a nationally recognized pricing guide at the time of cancellation, adjusted for the car's condition when traded in.
When does the money have to be paid?
The dealer must cancel the contract and refund within 48 hours of the cancellation, minus allowed deductions. If the buyer paid by check or another method that does not transfer funds immediately, the dealer may wait until two business days after the payment is verified (1784.43(d)).

What else do people ask?
Does the buyer get the trade-in back if it still has a loan?
Yes, the vehicle itself is returned. Loan deductions apply when the dealer pays cash for a trade-in it already sold.
Must the dealer explain this in writing before the sale?
Yes. The trade-in rules must appear on the separate 3-day cancel form (1784.43(b)(8) and (9)).
Is there a dollar fine?
1784.43 lists these as violations but sets no dollar fine in that section. See our CARS Act penalty guide.
