What must the first page of a NYC self-storage occupancy agreement include?

Quick answer

From November 1, 2026, the first page or pages of a new NYC self-storage occupancy agreement must clearly show the Lien Law 182 disclosures, the itemized amount due for the initial transaction, how long the first-month fee is guaranteed, the maximum fee for the first 12 months, and a bold notice that unpaid charges can lead to denied access and sale.

Does everything have to fit on page one?

No. DCWP changed the final rule so the required information may run from the first page onto the following pages; the rule says "first page(s)" (2-494(b)(5)). Keep it at the very start of the agreement and clear and conspicuous.

Do I have to re-sign existing tenants?

The occupancy agreement rules apply only to agreements entered into after the effective date (2-494(b)(1)). Existing occupants still get the other notices, such as the 60-day increase notice and, before each anniversary, the 12-month maximum fee notice (2-494(h)).

What is the 12-month maximum fee?

The highest occupancy fee you could charge in the first 12 months after signing (2-494(b)(5)(iv)). Charging above the maximum stated in the required notices is a deceptive trade practice (2-497).

What else do people ask?

Is the bold notice wording fixed?

Yes. The rule gives the exact text; insert your operator name in the bracket (2-494(b)(5)(v)).

Does the bill need a warning too?

Yes. Each billing statement must say that if charges are not paid by a stated date, the operator may deny access and, after notice, sell property to recoup unpaid charges (2-494(f)).

What is the fine?

$750 for a first violation of the agreement content rules (6 RCNY 6-90). See our NYC self-storage fines guide.
