How much can a Maryland self-storage facility charge as a late fee?

Last updated October 25, 2026 · Last verified October 25, 2026 against the official sources linked below · General information, not legal advice

Quick answer

Up to the greater of $20 a month or 20% of the monthly rent, for each month the rent is not paid on time. The facility can only charge it if the rental agreement states the amount of the fee and when it is charged (Md. Code, Commercial Law 18-504(l)). The late fee can be charged on top of other remedies, such as the storage lien.

How do I work out the cap for my units?

Take 20% of the monthly rent and compare it with $20. The larger number is the most you can charge per month. For a $150 unit, 20% is $30, so the cap is $30. For an $80 unit, 20% is $16, so the cap is $20.

What if my rental agreement does not mention a late fee?

Then you cannot charge one under this subsection. Section 18-504(l)(3) requires the agreement to state both the amount of the fee and when it is charged. A "rental agreement" includes any written agreement that sets or changes the terms of use (18-501(h)).

Is the late fee part of the lien?

The storage lien covers rent, labor or other charges, and expenses reasonably incurred in a sale (18-503(a)). The statute does not say in so many words whether a late fee is one of those "other charges". We quote it as written; ask a Maryland lawyer if you plan to recover late fees through a lien sale.

What else do people ask?

Can I charge a late fee every month the rent is late?

Yes, the statute allows a fee "for each month" rent is not paid when due, within the cap.

When is a tenant in default?

When they fail to perform on time any obligation in the rental agreement (18-501(b)). A lien sale needs default for more than 60 days (18-504(a)).

Is there a fine for charging too much?

The self-storage sections we read set no fine of their own. Overcharging still breaks the statute; ask a Maryland lawyer about other consequences.
