How does a Maryland self-storage facility sell a tenant's property for unpaid rent?

Last updated October 25, 2026 · Last verified October 25, 2026 against the official sources linked below · General information, not legal advice

Quick answer

Only after the tenant has been in default for more than 60 days. The facility must first send a default notice that demands payment within at least 14 days, then notify the tenant of the time, place and terms of the sale at least 10 days before it, and advertise the sale at least 3 days before it. The sale is public, for cash, and held at the facility or on an online auction site (Md. Code, Commercial Law 18-504).

Can I lock the tenant out before the sale?

Yes. If the occupant is in default, the operator may deny access to the leased space (18-504(h)).

What does the rental agreement have to say first?

It must contain the bold statement required by 18-503(b): that there is a lien, that property may be sold on default, that a vehicle or boat may be towed after more than 60 days in default, and how a sale is advertised. Email notices also need their own bold clause initialed by the tenant (18-504(b)(2)).

What protects the operator if it follows the steps?

If the operator complies with the subtitle, its liability to the occupant is limited to the net proceeds of the sale (18-504(g)). A good-faith buyer takes the property free of the occupant's rights and other liens (18-504(f)).
