Can an Oregon online store add shipping on top of the advertised price?

Last updated October 27, 2026 · Last verified October 25, 2026 against the official sources linked below · General information, not legal advice

Quick answer

Yes, but only reasonable charges you actually incur to ship the goods (ORS 646A.087(1)(b)). Separately, any seller that ships consumer goods to an Oregon buyer must clearly disclose, during the sale, the shipping and handling charges the buyer must pay (ORS 646A.093(2)). Other fees the buyer must pay belong inside the online price.

Can I add a separate "handling" fee outside the price?

The two sections do not line up word for word. ORS 646A.087 lets an online price leave out only reasonable shipping costs actually incurred (plus government taxes and a distance or selection-based service fee), and does not mention handling. ORS 646A.093 requires "handling and shipping" charges to be disclosed during the sale. We do not pick a reading; ask an Oregon lawyer before showing a handling fee outside the online price.

Does a flat shipping rate count as "actually incurred"?

The statute says "reasonable charges that the person actually incurs to ship". It does not mention flat rates or averages. Keeping records of your real carrier costs helps show the charge is reasonable.

Does 646A.093 apply to in-store sales?

It covers sellers that offer, sell or advertise consumer goods they will ship directly to a consumer in Oregon, including ads in print, broadcast or electronic media (646A.093(1)(a), (2)).

Where do these rules come from?

ORS 646A.087 was added by Oregon Laws 2025, chapter 311 (SB 430). ORS 646A.093 dates from Oregon Laws 2013, chapter 433.
